Existing Records Only
The Texas Public Information Act generally requires governmental bodiesto provide access to public information that is already in existence and maintained by the governmental body.
A public information request does not require CCISD to:
Answer questions that do not seek existing records;
Create a new document, report, spreadsheet, database, or other record;
Perform legal research or analyze for a requester; or
Compile or manipulate information into a format that does not already exist when doing so would require the creation of a new record.
Response Timeline
The Texas Public Information Act requires governmental bodies to respond promptly to requests for public information.
CCISD will provide responsive public information for inspection or duplication as promptly as practicable. If the information cannot be produced within 10 business days, CCISD will provide written notice stating that additional time is required and specifying a reasonable date and time by which the information will be available.
The actual processing time may vary depending on the scope, volume, location, format, complexity, and legal status of the requested records.
Requests that require review for confidential or excepted information, consultation with other departments, retrieval from archived locations, or an Attorney General ruling may require additional time as permitted by law.
Cost Estimates and Fees
CCISD may charge allowable costs for providing copies of public information in accordance with the Texas Public Information Act and applicable rules.
If estimated charges for copies or other allowable costs exceed $40, CCISD will provide a written, itemized cost estimate as required by Texas Government Code § 552.2615. The estimate will include information concerning the requester's options and applicable response deadlines.
Requesters may be responsible for timely payment of charges that are properly assessed under the Texas Public Information Act.
When permitted by law, CCISD may require a deposit or bond for anticipated costs. CCISD may also require payment of qualifying unpaid amounts from previous public information requests.
Confidential or Excepted Information
The Texas Public Information Act contains exceptions to required disclosure. Some information is confidential under state or federal law, while other information may be withheld under an applicable exception.
CCISD will review requested information to determine whether any portion is confidential or excepted from disclosure.
When required, CCISD will seek a ruling from the Texas Attorney General's Open Records Division regarding whether requested information may be withheld. CCISD will provide the requester with the notices required by law.
A requester may have an opportunity to submit written arguments to the Attorney General supporting disclosure of the requested information.
Designated Methods for Submitting Requests
Important: Please use CCISD's designated public-information email address rather than a general employee, campus, or department email address when submitting a public information request.
Texas law permits a governmental body to designate one mailing address and one electronic mail address for receiving written public information requests.
